Definition Of “Parent”

Despite Hong Kong’s recent landmark ruling on the recognition of same sex partnerships, uncertainties still persist and parental rights for same-sex partners remain limited. The government is set to establish some form of civil partnership framework for same-sex couples, but it is still unclear as to whether they will have rights to adoption or surrogacy if they wish to expand their families.

Rita Ku recently spoke with Cable News on the matter, noting that for same-sex female couples, the woman who carries the child will have parental rights, while for same-sex male couples, parental rights will be awarded to the man who provided his sperm. She also mentions that an array of laws need to be amended following the court’s ruling, including the definition of “parent”, which already carries a connotative meaning of masculinity and femininity.
